Billing tip: responsible management of contracts

As we head into summer vacation time, this is a friendly reminder that LABC contracts with you, not your firm. 

Under our General Terms and Conditions, you’re required to maintain conduct of any contract in your name. You’re welcome to have an alternative service provider (ASP) assist a client provided such assistance is in accordance with our tariffs. Please note that if another lawyer needs to assume conduct of a file, a change of counsel should be requested. Any services provided by an ASP should be documented in the invoice. 

When you submit an invoice, you must certify that you: 

  1. Reviewed the invoice before submitting it to LABC; 
  2. Performed or supervised an ASP or articled student to perform the legal services billed for on the dates recorded on the invoice; 
  3. Made reasonable efforts to ensure legal fees and disbursements were reasonable and necessary; and 
  4. Are entitled to receive payment according to the tariff contract. 

While we appreciate those with administrative and other firm supports may rely on these supports in your billing process, we remind you that you are responsible for any services provided to the client and any resulting billing; therefore, you must ensure the billing is correct.
